NDPS COURT MAPUCA DISMISSES APPLICATION FILED BY SOCIAL ACTIVISTS CHALLENGING CRIME BRANCH INVESTIGATION

MAPUCA: The NDPS court at Mapusa has dismissed an application filed by social activists alleging that the crime branch was not conducting proper investigations into the alleged activities of former ANC police sub inspector (PSI) Sunil Gudlar.
The PSI was exposed on camera demanding bribe from the sister of alleged Israeli drug dealer David Driham alias Dudu.
While rejecting the application, the court observed that there is prima facie no material to indicate that the crime branch police officers had made any attempts to interfere with the course of justice, warranting commencement of contempt proceedings against them.  "Since the FIR has already been registered, the circumstances do not warrant initiating contempt proceedings for not registering the FIR," judge PV Sawaikar observed.
However, the court has granted liberty to the applicants to approach the appropriate magistrate in case any attempt was made to intimidate or induce them to withdraw the complaint.
After initial inquiry by the crime branch, the police handed over the case to the special investigation team (SIT). The SIT is yet to come out with its report.
Activist Kashinath Shetye and others in their application had alleged that even as they were demanding that the crime branch register an FIR, a police officer of the rank of inspector from the crime branch approached five of the activists and threatened them with dire consequences.
However, the crime branch had refuted the charges as baseless and stated that DySP (crime) Shamba Sawant had conducted the inquiry in a fair and impartial manner and had submitted a report to the police headquarters that Shetye's petition needs to be registered on priority.
