NO ONE KILLED CIPRIANO by K. R. Sreenivas

I was compelled to write this headline after I watched “No One Killed Jessica”, a movie inspired by a Times of India headline and based on a real-life story. While the killers of Jessica Lall were brought to book, thanks largely to a resolute Sabrina Lall, Jessica’s sister, media pressure and public outcry for over a decade, hundreds of murder cases and custodial deaths have remained unsolved for years in our country. And the ordeal the victims’ families go through cannot even be imagined by the rest of us who lead our busy lives.
Cipriano Fernandes died in police custody nearly three weeks ago in Goa, yet the policemen have gone scot-free so far, being protected by every stretch of the arm of law. While the law is supposed to protect the rights of individuals, most often, it is bent to suit and protect the offenders.
On Friday, the sub-divisional magistrate and deputy collector, Sabaji Shetye, deposing before the judicial magistrate first class (JMFC) in Old Goa, stated in no uncertain terms that Cipriano died due to head injuries sustained in police custody. Shetye, who is conducting the probe into the alleged custodial death of Cipriano, said that according to medical reports and other material on record, it was clear that two of the injuries on Cipriano’s head were fatal and were caused while he was in police custody.
This has been confirmed by Goa Medical College and Hospital’s forensic department head, Dr Silvano Dias Sapeco, who said the death was caused due to two head injuries sustained by blunt force which led to the swelling of the brain.
Time and again, killers have got away in India and many a time, justice delayed is justice denied. Police have a poor track record in matters of custodial death.
The way police have attempted to manipulate public opinion in Cipriano’s case from the time Panjim Police picked up Cipriano and the conflicting stories they have tried to project on where they picked him up and why they arrested him in the first place, clearly points to foul play. When pressure built on them, Panjim Police tried to character-assassinate Cipriano. How does it matter what character Cipriano Fernandes had?
Here are the facts of the case: Cipriano was arrested on January 7, 2011, from his aunt’s house in Porvorim across the Mandovi River, based on a complaint by his girlfriend, Georgina Nunes, who stays in Caranzalem. He was taken under preventive arrest for threatening to kill her, police say.
The inside story goes that Cirpriano was having an affair with Georgina, a widow, and wanted to marry her. He was so passionate about the woman that he threatened to harm her if she did not marry him. Agitated by his behaviour, it is alleged, the woman complained to a powerful politician in her area, who is also a minister in the Congress government in Goa, telling him of her woes.
The minister is known to protect his voters no end, like a Robin Hood figure. He has the money and the muscle power to accomplish whatever he wants, it is said. If he feels the problem is genuine, he will go to any extent to resolve it.
Thus the minister wanted Cipriano to be taught a lesson. He told one of his confidants and close police aides to teach Cipriano a lesson. So, while the Panjim police team went to pick up Cipriano in a jeep, the policeman who was given the task of teaching Cipriano a lesson by the politician accompanied them in plain clothes. On record, he was not on duty at the Panjim police station on the said day, sources said.
It is said Panjim Police inspector Sandesh Chodankar, since suspended in this case, was at home at that time. He, sources say, was not at the police station at the time of the crime. His mistake was he had not put a station entry that he was leaving his office that day. But he cannot abdicate his responsibility.
The government has since suspended police inspector Sandesh Chodankar, sub-inspector Radesh Ramnathkar and head constable Sandip Shirvaikar, in the case involving Cipriano’s death. There are others who were on duty at the police station against whom no action has been taken so far.
Another interesting fact that has since come out is that the alcohol detection test report which has been received a couple of days ago from the forensic laboratory, Surat, Gujarat, where the sample was sent, has confirmed that Cipriano was not under the influence of alcohol at the time of arrest, as alleged by police. This makes it clear that another fact had been concocted by police. The police had stated that Cipriano was misbehaving under the influence of alcohol.
The histopathology report, which too has since come out, clearly states that Cipriano had neither consumed poison nor alcohol as alleged by the police. All these stories being planted by police in the media clearly show that they are on a cover-up operation. And the experience is, policemen are often good at cover-ups.
Interestingly, Georgina Nunes, who had first complained against Cipriano had accompanied the police when they picked up Cipriano. She has since alleged in the media that police had tortured Cipriano in the jeep. He was hospitalised on January 8 as his condition was bad, and breathed his last on the morning of January 9.
Cipriano’s cousin, Cosme Fernandes, has demanded that action be taken against all the culprits and they be put behind bars. He has also demanded that the driver of the police jeep, in which Cipriano was taken to police station, be questioned.
The family is now doing the familiar running from pillar to post seeking justice. Human rights activists have started making some noises. Police say they have done nothing wrong. “Investigations are on,” they say routinely. But will Cipriano’s killers be punished? Will the real culprits be caught and convicted? Only time will tell.   1. Our elders used to say in Konkani to cover one lie you have to tell seven lies. That is exactly what Some of our corrupt law enforcers have done and have been doing so ever since the so called liberation. A lot of evil lessons have been learnt from Law enforcers of other parts of India, where Rapes and deaths in custody have gone unpunished, or cases are languishing in courts.

    CAn some one please name the MLA or "Powerful" Politician.?
    I personally do not like the term "Powerful", to be applied to Goa`s MLA.The more appropriate term should be: "CORRUPT","UNEDUCATED","GOONDA",& "MURDEROUS".
    My instinct leads me to believe that the MLA involved here is Babush Monseratte.He is a well known THUG.He is more a wild animal,but in human form
    He wears his shirts,with short sleeves in such a way, to show his muscles and goonda origins.
    I must admit his wife Jennifer too has no decorum or modesty.

While I in the process of preparing the NG football team for our next tournament and went for shopping for our uniforms with some of my team members, I chose the colour of our team jerseys to be Khaki. everyone objected and said the colour looked rubbish. And I told them, baba, although it looks rubbish, it has many advantages. I told them we can play rough on the ground, kick some of the opponents and raise our hands in self-defence and the refree will foul the opponents. Why? They questioned. And I said because khaki ia all powerfull just like the Goa Police. you can get away with anything you do, wherether it is right or wrong. Anyway, I was voted out because my team of NG does not believe in any wrong doing and they want to play a fair and disciplined game. So now we are going for another colour.

    This makes sense. The enthusiasm of the police to arrest someone at night for a non-cognizable offense and knock the daylights out of him had to have a motive. Both the driver (Ryan) as well as the girlfriend(Georgina) need to be arrested and investigated for the truth.

    I agree with Anonymous.Having read the story of Cipriano,Ryan seems to be an accessory to the crime.This is what was stated by Georgina.
    Gerogina has actually punished herself, as for the rest of her life she will have to live with the Guilt of this whole sad episode.
    I am not sure at this stage if she had any power to stop the beatings.It would make her request to the Police for protection, seem foolish.
    I am have not heard anywhere Ryans version of the incident.
    Ryan has no need in saving the Police,by providing a false witness statements.
    It would be decent for him to provide the truth now.

  6. As the story hailing from the constituency of the Uneducated Education Minister, The MLA concerned could not be other than the Monster Rat. The culprits should be hanged in public and Ryan and Nunes too should be arrested.

  7. the earlier stories about ciriano being stone drunk when arrested, supposedly told by his relatives is infact a character assasination of cipriano by the police to cover up their murder. Now that the proof has come out, what will they think of next? Keep on lying to the public, nobody takes you seriously. Niz Goenkar, thank you for the voice of the people is beng heard.
    PI Sandesh chodankar earlier tried to push the buck to the GMC hospital staff, that too failed. Now they say the PI was at home, but he didnt sign off, why? unless he was expecting overtime hours.

  8. @ Neville: According to the eye witness the PI was present at the Police Station and he even KICKED the dead body of Cipriano to make sure that he died completely. Then how can he now say that he was not there?

    To Shyam & Neville:::: I did not know, that the Goa Police also have "GHOSTS" that come alive, at the Police Station precints, while their physical manifestations are at home.
    I am still trying to figure out how these "Ghosts" kill at the Police Stations.
    Can anyone care, to explain to me.?
    Now, I would like to know whether PI Chodankar and the other 2 brutes, who murdered Cipriano were in their Police Uniforms.If they were, then they were on Duty, as they could not have been attending a "FANCY DRESS" party.
    If they were not in uniform, then they should still be punished as "Common Criminals".
    It seems like PI Chodankar, like his boss Raviski Naikov, is trying all the possible excuses to keep out of jail.
    Watching Raviski Naikov`s performance at the Goa Legislature today (4.2.2011),where he got a good trouncing,I also begin to wonder how he, was ever made a HOME MINISTER.I am sure he has paid "Tricky Dicky" Kamat good money to get the position and continues to do so.
    I think Andrew F / Stormrider would do sterling service to Goa,by giving Raviski some good elocution lessons instead of Monkeying about with Niz Goenkars.
    As the famous PINK FLOYD song from their album / film "THE WALL" said..."WE (NIZ GOENKARS) DONT NEED NO EDUCATION" & "WE DON`T NEED NO GROUND CONTROL".
    I would also like to meet our expert, Shirish Thorat,so I could learn from him, how to give Raviski a damn good "SLAP".!!!

  10. @ Shyam Sawant, yes sir, these are revisions. When one lie crumbles, up comes another version. Bare fact remamins, he was present there and kicked the victim, so heartless, cold blooded muderer. Now he's got no guts to admit his crime and is even afraid of the meter readers. like mr renoir says, God alone knows how many custodial deaths have taken place in Goa and brushed under the carpet.

Ravisko Naikovich may try to suppress this murder and save PI Santoshko Chodanskov from gallows but we all Goans should unite against these rascals. N. Fernandes and Shyam and Neville do not leave me out of this.

  12. @Sandesh gaonkar, welcome brother, we are niz goenkars. Together we have to fight against these criminal activities by the men in uniform, like Mr N fernandes rightly says Ravi naik & sons along with the goa police have taken the goa drug buisness to corporate levels. Seriously, I wish that Geeta & her mother, another victims of police brutality get justice too.
