STATE INFORMATION COMMISSION SUMMONS GOA GOVERNOR DR. S.S.SIDHU

PANJIM: Goa State Information Commission has today issued notice to Goa Governor Dr. S.S. Sidhu directing him to personally appear before the commission on 4th January 2011 at 10.30 am in connection with the complaint filed against him by Adv. Aires Rodrigues for non- complying with the Right to Information Act. The Commission has also issued notice directing the Special Secretary to the Governor Dr. N.Radhakrishnan to also remain present.
The notice to Goa Governor follows the petition filed yesterday by Adv. Aires Rodrigues against Goa Governor Dr S.S. Sidhu for his failure to comply with the provisions of the Right to Information Act.
As the Goa Governor had been claiming that he is not a public authority and does not come within the purview of the RTI Act, Adv. Aires Rodrigues had last week served a legal notice on Goa Governor giving Dr Sidhu 48 hours to furnish information under the Right to Information Act.
In his petition before the State Information Commission yesterday Adv. Aires Rodrigues has stated that the office of the Governor is a constitutional post within the definition of “Public authority” under section 2 (h) (a) of the RTI Act.
Adv. Rodrigues has stated that as the Governor has been notified as a public authority he was bound to furnish the information sought and that the refusal was contrary to the RTI Act, unreasonable, malafide and without reasonable cause.
Adv. Rodrigues has also stated that Governor had to furnish the information sought and cannot claim not be a Public authority just because an affidavit has been filed before the High Court that he is not a public Authority.
Adv. Rodrigues has further submitted in his petition to the State Information Commission that the Governor is bound to comply with all the provisions of the Right to Information Act.
Adv. Rodrigues has in his petition also sought that the Governor of Goa be penalized in terms of section 20 of the RTI Act for not furnishing the information sought.
Adv. Aires Rodrigues by an application dated 29th November had sought from Raj Bhavan under the Right to Information Act details of action taken on the complaints made by him to the Governor of Goa against Advocate General of Goa Mr. Subodh Kantak. Adv. Rodrigues had also sought copies of noting sheets and correspondence pertaining to the processing of his complaints against the Advocate General.
In a letter to Adv. Aires Rodrigues dated 30th November, Special Secretary to Governor, Dr. N.Radhakrishnan declined to furnish the information, stating that information under RTI Act could not be furnished as the Governor of Goa is not a Public Authority and that an affidavit to this effect has been filed before the Bombay High Court at Goa.

    This is the RTI act Aires is challenging Dr Siddhu with it.See below.

    Please note that Dr Siddhu is not offering his services to Goa for free.He is not a "Charity" or a "PUPPET".
    He is being very well paid by Taxpayers and so we shoud all have a right to take him to task.
    The RTI applies to all Government bodies / agencies.The Governor is an apointee and employee of the Central Government.
    Dr Siddhu has been appointed "under the Constitutuon of India."....certainly Not by the constitution of Timbaktu!!!

    2. In this Act, unless the context otherwise requires,—
    (a) "appropriate Government" means in relation to a public authority which is established, constituted, owned, controlled or substantially financed by funds provided directly or indirectly—
    (i) by the Central Government or the Union territory administration, the Central Government;
    (ii) by the State Government, the State Government;



    (h) "public authority" means any authority or body or institution of self- government established or constituted—
    (a) by or under the Constitution;
    (b) by any other law made by Parliament;
    (c) by any other law made by State Legislature;
    (d) by notification issued or order made by the appropriate Government,
    and includes any—
    (i) body owned, controlled or substantially financed;
    (ii) non-Government organisation substantially financed,
    directly or indirectly by funds provided by the appropriate Government;

Great work by great son of Goa Aires Rodrigues,you make us Goan proud by shaking the Great work by great son of Goa Aires Rodrigues, you make us Goan proud by shaking the Turban of Sardar.Hope at least now he realizes his mistake and come out with information as per RTI Act. Governor office is not his father property where he can do what he like without being questioned. He has brought disrespect to the office of Governor, indeed by now he should have either apologized or commit suicide by jumping over Aguada fort.
    Aires our full support for you,don't afraid of Indian Dog, now screwed the Governor Sardar balls with a screwdriver so that he can spend rest of his life by scratching his balls.
