LOUD MUSIC PLUS THREATENING THE POLICE LANDS A COUPLE IN POLICE NET

PANJIM: A couple from Caranzalem was booked for playing loud music in their garden and later threatening Panjim cops who went to stop the music late Saturday night.
Raul Trazeres and his wife had hosted a party at their residence in Caranzalem and were allegedly playing loud music in the garden.
Annoyed with the loud music a few neighbours complained to the Panjim police at about 9.10 pm. When the police went to check, they found that loud music was being played in the couple's garden.
The police requested them to switch off the music system as it was causing inconvenience to the neighbours but to no avail.
As the couple didn't stop playing loud music beyond the permissible time limit of 10 pm, neighbours again complained to the police and a police team led by PSI Ramnathkar went to their residence. However, the couple refused to listen to the police.
"When we seized the music system, the couple threatened us with dire consequences and obstructed us from carrying out our duty. We have registered a case against the couple for obstructing us from carrying out our lawful duty and threatening us", police said. (TNN)

    Reading this article / news story , it seems like a case of "double jeopardy".Both the Couple and the Police are at fault.
    The Police firstly, for asking the couple to stop playing the music within the permissible time of 9.10pm.
    This request made to the couple at 9.10 pm would have surely incited the couple and their guests.
    It would have been seen as the Police abusing their powers.It seems like the Police have not applied due diligence or common sense.

    It seems to me, like there must be some enemity and jealousy between this couple and some neighbours.

    The couple too, have exceeded their Loud Music Limit /deadline.However I think they were provoked and humilated to take this measure.
    I view this as purely a culpable incident.

    To assist some readers, I am adding the Legal definition;

    "Culpability generally implies that an act performed is wrong but does not involve any evil intent by the wrongdoer. The connotation of the term is fault rather than malice or a guilty purpose. It has limited significance in Criminal Law except in cases of reckless Homicide in which a person acts negligently or demonstrates a reckless disregard for life, which results in another person's death. In general, however, culpability has milder connotations. It is used to mean reprehensible rather than wantonly or grossly negligent behavior. Culpable conduct may be wrong but it is not necessarily criminal."

    It will however be interesting to see how the Police treat this case.
    Another question and mystery arises and the most probable....
    Were the Police looking for a finiancial bribe to allow the Loud music to continue between 9.10 pm & 10.00pm.????
    let us all await and see some more facts emerge.


    The Couple in return have broken the 10.00pm rule on playing lougd music.
