CONDITIONAL BAIL TO COUPLE IN DOWRY HARASSMENT CASE

MARGAO: The first additional district and sessions judge, South Goa, Margao, Mr Desmond D’Costa, on Saturday granted conditional anticipatory bail to a couple, who was charged for cruelty related to dowry demand by their daughter-in-law.
Mr Maruti Gavali and his wife, Ms Sunanda had approached the sessions court for the anticipatory bail after their daughter-in-law, Ms Shreya had filed a complaint at the Maina-Curtorim police station that her father-in-law and mother-in-law had subjected her to cruelty, harassment and mental torture over dowry demand. Following the complaint the police had registered an offence under section 498-A of Indian Penal Code (IPC) against the duo.
Public prosecutor, Ms Asha Arsekar represented the state while Mr Pritam Morais argued on behalf of the applicants. The additional district and sessions judge in his order observed that the offence under section 498-A is cruelty by the husband or relatives of the husband and is punishable with imprisonment for three years and fine. The said offence is cognizable and non-bailable.
The court also observed that it has to take into consideration the gravity and nature of offence, the antecedents of the applicants, the possibility of fleeing from justice and whether the accusation is made to injure or humiliate the applicants. The court also directed the applicants to report to the investigating officer for five days and that in the event of their arrest the applicants be released on personal bond of ` 10,000 with one surety.
