CBI REGISTERS ‘WHAT IS LEFT OVER’ CASE OF POLICE-DRUGS NEXUS AND DUDU CASE

PANJIM: The central bureau of investigation's (CBI) anti-corruption bureau (ACB) on Wednesday registered Goa's infamous police drug nexus case and Dudu case as per the directions of the high court of Bombay at Goa. The PSI Sunil Gudlar case, however, is yet to be registered on technical ground.
"As per the high court order we have already registered two cases and investigation is under process and third case (PSI Sunil Gudlar case) will be registered soon," said CBI, superintendent of police S S Gavali
It may be recalled that the high court of Bombay at Goa had disposed of a petition filed by Sunil Kawathankar, president of National Students Union of India (NSUI), demanding an inquiry by the CBI into drug nexus cases. CBI's counsel Carlos Ferreira had stated that a notification under Section 5 of the Delhi Special Police Establishment Act authorizing the CBI to take over the cases will be issued.
However CBI is yet to register the PSI Sunil Gudlar case due to some technical point raised by the CBI in notification issue by central government. Sources in CBI said that the notification issued to register the case against Gudlar who allegedly demanded bribe from Israeli drug dealer Dadu's sister, state government has mentioned that this case should be investigated under section 14 (1) (d) under the prevention of corruption act, "there is no section called 14 (1) (d) under the prevention of corruption act. Therefore, we have sought a clarification from the state government before registering the case," CBI sources said.
Sources confirmed that the "state government has issued a corrigendum and sent the corrigendum to the central government to make necessary change so that CBI can register the Gudlar case as per the High court order".
CBI has also decided to inform High Court that they have taken over the investigation in Dudu's case which was earlier chargesheeted by anti-narcotic cell for further investigation, CBI sources said.
The documents and case papers pertaining to these cases have already been sought from respective investigation agencies. "We have yet to receive the case papers and documents," said sources.  The case has been looked upon by deputy inspector general of CBI ACB Goa Praveen Salunke and SP S S Gavali. - TNN
