HIGH COURT DENIES BAIL TO MICKKY PACHECO

PANJIM, JULY 19: Bombay High Court at Goa today rejected the bail petition of former Tourism Minister Mickky Pacheco. Passing the order today evening, Justice A S Oka said that at this stage the court is not inclined to grant him (Pacheco) bail.

However, the court said that Pacheco can move appropriate authorities seeking permission to attend the ongoing assembly session.
Earlier during argument, Advocate Surendra Desai, representing Pacheco pointed out that the Crime Branch has not interrogated Pacheco for last two to three days and as such there is no need of further custodial interrogation.
He even brought to the notice of the court that police so far failed to get information from the five mobile handsets and three SIM cards recovered from Pacheco’s residence.

Desai also said that there was nothing to prove that Pacheco would destroy the evidence. “Even when Pacheco was missing he never tried to temper with the evidence,” Desai said. Desai also said that the entire case was based on circumstances and there were no direct evidence to prove that Pacheco has provoked Nadia’s suicide “Nadia being just a friend of Pacheco, there is no evidence which proves him guilty,’ he said “The statements recorded from the family members of the victim has also not indicted that Pacheco is involved in the crime. Nor the phone call records have proved that,” the lawyer added.
Desai contented that Pacheco is innocent as he had accompanied Nadia to various hospitals and tried to save her life. Desai also clarified that of the 14 injuries found on the body of Nadia, three were surgical, two caused during hospitalization and rest are related to her disease, acute liver failure, which she was suffering from. Desai said that it would be humiliating to Pacheco to attend the ongoing assembly session escorted by police and hence bail should be granted to him. Public prosecutor C Fereira said that the Crime Branch is yet to recover two mobiles and a laptop used by Nadia.
He mentioned that even after Nadia’s death on May 30, one of her mobile was being used, till June 5. Fereira said that the police are also yet to recover the blunt object allegedly used to hit Nadia, which is evident from the postmortem report which shows injuries on her body.

What is happening in Goa right now is unimaginable. The corrupt seems to be on the rise and the honest seems to be on decline.
