ASSAGAO LAND GRABBING LANDS KHALAP’S SON IN THE COURT

PANJIM: A Gaunkar of Assagao Comunidade has filed a petition before the Bombay High Court at Goa against Ashwin Khalap, son of Goa Law Commission Chairman Ramakant Khalap in connection with the alleged Assagao Comunidade land illegally grabbed by him.
The petitioner, Nelson Fernandes in his petition has alleged that Comunidade land was transferred in the name of Ashwin Khalap by a tenant Mahadev Sitaram Simepuruskar illegally and fraudulently on which the accused had started construction of seven luxurious villas.
Fernandes in his petition has alleged that the authorities have illegally transferred 15,000 sq metres of prime Comunidade land to Khalap Jr. As such the petitioner has sought that the land illegally transferred to Khalap Jr be reverted back to the Comunidade of Assagao. He has also requested the Court hat the construction work of luxury villas on the said land be immediately stopped.
The petitioner has contented that tenanted agricultural Comunidade land cannot be sold as there is a prohibition imposed by the Goa Land Use Regulation Act and the Goa Agricultural Tenancy act.
He has further submitted that law prohibits use of agricultural land for non-agricultural purpose.The State of Goa, Comunidade of Assagao and the Deputy Collector along with the Mamlatdar of Bardez and the tenant have been made parties to the petition. The matter is likely to be heard next week.
