PANJIM: Chief Justice of the Bombay High Court Mohit Shah has been urged in public interest not to transfer Judge Ms. Kshama Joshi to Panjim. Judge Kshama Joshi is being transferred from Vasco Court to Panjim in place of Judge Edgar Fernandes who has been transferred to Vasco.
In a letter to the Chief Justice of the Bombay High Court Adv. Aires Rodrigues has drawn the attention of the Chief Justice that it would not be proper to post Judge Kshama Joshi at Panjim since her husband Adv. M.S.Joshi is a practicing Advocate in Panjim Courts including the Court where Judge Joshi is being transferred.
Adv. Rodrigues has stated that even if Advocate M.S.Joshi undertakes not to appear before his wife Judge that other lawyers from Adv. Joshi’s office would be appearing before Judge Kshama Joshi.
Adv. Rodrigues in his letter has further stated that such a situation would not be conducive and appropriate in view of the high standards of professional ethics and judicial propriety envisaged by the Honourable Chief Justice of the Supreme Court of India.
Adv. Rodrigues has in his letter to Chief Justice Mohit Shah suggested that it would be proper that Judge Kshama Joshi be transferred to any Court in South Goa so that there is no room for any direct or indirect conflict of interest.
