The revelation by former Union Law Minister Shanti Bhushan that eight of the 16 Chief Justices of India were corrupt is very disturbing and a matter of great concern. That even judges were recently caught copying only reinforces the need for stringent procedures in their selection. The manner in which High court judges are currently picked is not acceptable.
The process lacks any transparency and is shrouded in secrecy. The vacancies of High court judges ought to be advertised to promote fair competition.. The selection panel could comprise of the Chief Justice of the High Court along with one or two Chief Justices of neighbouring states. Such a process would ensure the selection of only those persons of high integrity with sound knowledge of all fields of law together with an impeccable character.
We cannot afford to have erroneous judicial appointments. We may never know how Mr. S.C.Bora became a judge of the Bombay High court in 2008 and why he was relieved of his judicial duties in just a few months. The less said about that issue the better but the fact remains that there should never be a need for Judges to be judged. However, we must be vigilant to see if there are another few Boras still remaining as judges. The degradation of the judicial system cannot be allowed. Otherwise we will have the Kodas, the Laloos, Mulayams and the Mayawatis taking over India’s (in) Justice delivery system.
How many top posts are earned on merit in India? The judicial system is not immune from corruption. One can see the cases in Goan Courts where criminals are set free due to lack of evidence in spite of evidence being presented. It's a mockery of our Justice system.
ReplyDeleteWho selected Desmond D'costa as a Judge, Is it not Desmond was recruited when chor Luizinho was part of Congress Government?Desmond is not only corrupt but first class criminal who decided cases not as per merits but through underhands.The chief Justice of Bombay High Court have already apprehanded him for various wrong judgements but with strong backing from Chorchill & Luzinho he continue to make mockery of Judiciary system.
ReplyDeleteJudges to the High Courts and the Supreme Court should be like Justice Eurico Santano Silv, Dr. Soares, Dr. Couto, Dr. Menezes, Dr. Noronha etc. These were the real judges delivering judgment fearlessly and would never, ever succumb to bribes.
ReplyDeleteJudiciary in Goa has corrupted being in the hands of the same politicians. Remember the few judges who were terminated from services for corruption one being Dessai. Take the note of cases against different politicians and how they are handled. The police of Goa are also corrupt and failed to build up tight cases against the criminals due to the hafta system that makes their palms softer and slippery. The home Minister himself is protecting the criminals including his son. Goa's Advocate General Subodh Kantak is at the height of corruption.
ReplyDeleteI have totally lost hopes and truthfulness of the judiciary’s judgment in Goa with the present set of judges and advocates because they are all understanding the power of money and muscle only and even with the writer, what he is doing is just the same things what others are doing. I had earlier posted my comments on the article which the writer had posted on this blog “governments-flawed-priorities” and had questioned his identity about his involvement in certain cases and the same was even seconded by Janedesa and Dalia too. But he did not come out clean on this issue neither he dare to answer his innocence on the said standing. I think he is just bluffing us as the other politicians are doing to the present Goa. By bringing out articles as above wherein his same portfolios are involved, I think he is digging his own grave?
